"JIMMY'S DEALS MACBOOK" PROMOTION
HOW TO ENTER
To be eligible to enter and automatically receive one (1) entry into the Grand Prize Draw, individuals must register as a member on the "Jimmy's Deals" website, located at http://www.jimmysdeals.com.au.
Registered members may also be eligible to receive bonus entries into the Grand Prize Draw throughout the promotional period by completing the Jimmy's Survey and taking up other promotional offers appearing on the "Jimmy's Deals" website and contained in "Jimmy's Deals" emails from the Promoter, if the individual entrant agrees to receive such email correspondence.
Registered members may also invite friends and family members to register via the "Send to a Friend" form on the "Jimmy's Deals" website, and will receive twenty (20) bonus entries into the Grand Prize Draw for each friend/family member they nominate who subsequently registers as a member on the "Jimmy's Deals" website during the promotional period. The operation of the "Send to a Friend" mechanic is subject to the Spam Act 2003. Entrants should only nominate friends and family with whom they have a direct relationship with, and who consent to receiving these types of messages. Entries will not be awarded for nominating a friend/family member who has already registered prior to the invitation or received an invitation to register from another individual.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 13 years or over who have an Internet connection capable of accepting cookies or other devices used by the Promoter to track entries, and who have a valid email address.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete, indecipherable or illegible registration will be deemed invalid.
6. Limit one (1) registration permitted per person. Entrants will receive twenty (20) bonus entries for each friend/family member they refer who subsequently registers as a member on the "Jimmy's Deals" website during the Promotional Period.
7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
8. Promotion commences 01/12/08 and ends at 11:59pm AEDST on 30/06/09. The draw will take place Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne Vic 3004 on 15/07/09 at 2pm AEDST.
9. The winner will be notified by mail and the winner's name will be published in The Australian on 12/08/09.
10. The Promoter's decision is final and no correspondence will be entered into.
11. The first valid entry drawn will win an Apple Macbook Air valued at $AUD2,499.
12. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
13. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
14. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
15. Total prize pool value is up to AUD$2,499.
16. The prize is not transferable or exchangeable and cannot be taken as cash.
17. A draw for the prize, if it remains unclaimed, may take place on 12/11/09, at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner's name will be published in The Australian on 03/12/09.
18. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
20. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
21. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
23. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter via the Jimmy's Deals' website. All entries become the property of the Promoter.
